Outwest Property Doctor
In setting this appointment you agree to the terms of this contract in Full and completely by confirming this appointment.
Article 1. Documents
Outwest Property Doctor acknowledges that he has carefully examined and studied the contract documents in their entirety. Outwest Property Doctor fully understands the scope of the work to be performed by him under the contract documents.
Article 2. The Contract Price
The Person(s) requesting testing shall pay Outwest Property Doctor for all labor to be performed under the contract sum as stated per location and Per Test.. Payable to Outwest Property Doctor, Po box 1512 Missoula, Mt 59806; or through online payment. Test fees are required in full prior to test.
In The Event Of A Failed Test
At the request of Person(s) that requested the Test including the general contractor (GC),Owner or a representative duly authorized to act on their behalf, Outwest Property Doctor will remain on premises at a labor fee of $75.00 Per Hour, while you try and remedy the failed test. THIS REQUEST MAY BE MADE VERBABLY AND WITHOUT WRITTEN REQUEST. A one hour minimum is required. Outwest Property Doctor will offer to place smoke in duct systems for the duct air tightness tests to help identify problem areas but will perform no labor what so ever in resolving the issue. In the event the problem is not solved or your representative is not present; Outwest Property Doctor will return at another time and preform the test at half price. Half price for the second test is contingent upon another appointment within the city of your test location. Full price for the test will be charged in any other circumstance.
Article 3. Additions, Changes and Modifications to Contract.
The terms and conditions of the contract are not subject to addition, modifications or change, unless such addition modification or change is made in writing and is agreed upon by both Outwest Property Doctor, and a duly authorized representative of , owner/general contractor authorizing the testing.
Article 4. Right to Claim Lien
If at any time payment for labor is not made within 14 days of completion of work, Outwest Property Doctor reserves the right to withhold work and put a lien on the structure and or property. If any lien need be filed by Outwest Property Doctor the costs and all reasonable attorney’s fee and related expenses incurred shall be immediately due from owner/GC or person(s) scheduling this appointment.
Article 5. Hold Harmless
Owner/GC/ or Representative shall hold Outwest Property Doctor harmless from all claims by any other contractors, sub-contractors, suppliers, and/or their personnel arranged for by Owner/GC/ or Representative requesting the test.
